1. Introduction

Welcome to Perga Cloud. These Terms of Service ("Terms") govern your use of the Perga Cloud website and service. Perga Cloud is provided by Dmitrii Tiunov PR Beograd, a registered entrepreneur (preduzetnik) in Serbia, with registered address at Cika Ljubina 12/3, Belgrade, Serbia ("we", "us", or "our").

By accessing or using our service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our service.

2. Description of Service

Perga Cloud provides a hosted personal organizer application based on the open-source Perga project. The service includes daily planner, agendas, and note-taking features. We provide both free and potentially paid tiers of service.

3. User Accounts

To use Perga Cloud, you must create an account with a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating your account. You must be at least 18 years old to use this service.

4. Acceptable Use

You agree not to use the service for any illegal purposes or to conduct any activity that violates the rights of others. This includes, but is not limited to, storing or transmitting illegal content, attempting to gain unauthorized access to our systems, or interfering with the service's availability for other users. You are solely responsible for the content you store in Perga Cloud.

5. Intellectual Property

The Perga open-source software is licensed under the MIT License. The "Perga Cloud" hosted service, including its branding, custom website code, and proprietary infrastructure, is owned by us. Your use of the service does not grant you ownership of any intellectual property rights in the service or the content you access.

6. Data Ownership

You retain all rights to the data you input into Perga Cloud. By using the service, you grant us a limited license to store, process, and transmit your data as necessary to provide the service to you.

7. Limitation of Liability

Perga Cloud is provided "as is" and "as available" without any warranties, express or implied. To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages, including loss of data or profits, resulting from the use or inability to use the service.

8. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last updated" date. Continued use of the service after such changes constitutes your acceptance of the new Terms.

9. Termination

We may suspend or terminate your account and access to the Service at any time if you breach these Terms or if we reasonably believe your use of the Service may cause harm to us, other users, or third parties.

Where reasonably possible, we will provide prior notice and an opportunity to remedy the breach. However, we may suspend or terminate access immediately, without prior notice, in cases of serious violations, legal requirements, or security risks.
